We represented DNB bank on alleged miss-selling of structured products
DNB Bank AB had provided its clients with the possibility to invest in equity linked bonds, issued by the bank itself. A number of investors borrowed from this bank in order to invest in these bonds before the financial crisis. Later, they sued the bank in civil court for alleged miss-selling of structured products, also activities of the bank when offering these products were investigated by the supervisor. Our team represented the client as a defendant in a number of administrative as well as civil cases (more than 20 in total), two of which were the first class-actions brought before Lithuanian courts and one of which is an action brought by an association in order to protect public interest.
Our team advised on the development of strategic energy infrastructure of the Baltic region
These strategic projects involved the development of new power connections and the strengthening of the electricity transmission grid which will allow all Baltic States to join the Western European Electricity System and increase the security of energy supply. They will also ensure the potential for energy exports and imports in Europe. The infrastructure included power connection projects with Sweden and Poland and the development of a liquified natural gas (LNG) terminal in Klaipeda seaport.
We assisted our clients in negotiation and conclusion of complex agreements involving sophisticated technologies. We also contributed to the implementation of the projects by successfully defending their legality and urgency in the courts. Our input to the new case law will serve for the development of all infrastructural projects in Lithuania.
We represented Gordon Trade & Logistics Ltd in a dispute with Lithuanian Customs Authority
We were entrusted by Gordon Trade & Logistics Ltd with complex dispute regarding TARIC classification of goods transported through Lithuania to Belarus. As the result of our efforts the Lithuanian Supreme Court ruled in favour of our client and obliged Customs Authority to seek guidance from the European Commission regarding this matter. The dispute was important to litigation practice in Lithuania. It could be regarded as a precedent, revealing that complex TARIC classification issues may not be decided unilaterally by Lithuanian Customs authorities.
